The Florida Bar v Hall (08/26/10) Florida Supreme Court: Forensic document examiners had a hand in implicating a Florida attorney who had fraudulently altered a legal document during the course of conducting private business. The Supreme Court dealt with her disbarment on appeal by the Bar who were of the view the initial decision to suspend her for 90 days was lenient. The Court agreed unanimously and set out why.

McDonald v Chicago (06/28/10) U.S Supreme Court: In an action against the City of Chicago alleging that the City's handgun ban left plaintiffs vulnerable to criminals, judgment for defendants is reversed where the Fourteenth Amendment incorporates the Second Amendment right, recognized in Heller, to keep and bear arms for the purpose of self-defense.

Woodfox v Cain (06/21/10) USCA, 5th Circuit: (See linked News Article below) The 5th circuit ensures that long term solitary inmate Albert Woodfox is to remain there for the foreseeable future, despite human rights groups' vociferous objections.

Wal-Mart Stores, Inc. v. Merrell (06/18/10): Supreme Court of Texas. In plaintiffs' wrongful death and survival claims against Wal-Mart for the death of their son from smoke inhalation, claiming that a halogen lamp purchased from Wal-Mart caused the fire, the court of appeals' reversal of the trial court's grant of defendant's motion for summary judgment on the ground that plaintiffs produced evidence on each challenged element of their cause of action is reversed as, plaintiff's expert's testimony was legally insufficient to support causation.

09/16/10 (MS): Military Won't Notice End to Gay Ban Says Expert If Congress decides to let gay men and lesbians serve openly in the U.S. military, the reaction among the vast majority of soldiers is likely to be a big collective yawn, a leading historian said Thursday.


09/15/10 (IN): Law Professor Testifies as Ethics Expert at Impeachment Hearing Professor Geyh, the John F. Kimberling Professor of Law at Indiana University, has testified as an expert witness in the Senate Impeachment Trial Committee's proceedings on four articles of impeachment against the U.S. District Court judge for the Eastern District of Louisiana. Appointed in 1994, Porteous has been accused of declining to disqualify himself from a case in which he solicited money from a lawyer with whom he had a longstanding, corrupt relationship; giving bail bondsmen preferential treatment in exchange for meals, trips and services; perjuring himself in his bankruptcy proceeding; and lying under oath during his Senate confirmation proceedings.

09/01/10 (OR): Terrorism Expert: Charities Funded Islamic Fighters An expert witness for the prosecution has testified that Islamic charities based in Saudi Arabia, including the one an Oregon tree surgeon is accused of smuggling money for, were regular conduits of funding to Muslim fighters in the volatile Caucasus region.

06/21/10 (LA): 38 Years In Solitary Isn't Enough? Albert Woodfox has spent nearly all of the last 38 years in solitary confinement at the Louisiana State Penitentiary at Angola. His case has brought protests from Amnesty International and Human Rights Watch, who argue that Woodfox's decades in lockdown constitute torture, and from a growing band of supporters, who believe that he was denied a fair trial. For more than ten years, he has been fighting for his release in the courts. But now, a ruling by a federal appeals court ensured that for the forseeable future, Albert Woodfox will remain right where he has been for nearly four decades: in a 6 x 9 cell in the heart of America's largest and most notorious prison.
