  • Baze v Rees (U.S. Supreme Court, 4/16/08): The Court affirms earlier decision of the Kentucky Supreme Court that the state's capital punishment protocols do not violate the 8th Amendment banning cruel & unusual punishments.
  • Begay v United States (U.S. Supreme Court, 4/16/08): Armed Career Criminal Act. The Court considered whether New Mexico's DUI offense falls outside a 'violent felony' for the purposes of the Act.
  • Meadwestvaco Corp v Illinois Dept of Revenue (U.S. Supreme Court, 4/15/08) Taxation. In a wide ranging, unanimous decision, the Court found that, inter alia, the law imposes a distinct but parallel limitation on a state's power to tax out of state activities.

    4/30/08 (DC): Guantanamo Tribunals 'Tainted' Says Ex-Prosecutor Political pressure and evidence obtained through the abuse of prisoners has undermined the Guantanamo "war on terror" tribunals, their former chief prosecutor testified, US media reported.


    4/29/08 (NY): The Rights of The Batterer When Jimmy Byrd went on trial for nearly murdering the woman he lived with -- the mother of their young daughter -- the victim did not appear in court and Byrd's lawyer never cross-examined her. Byrd was convicted anyway. This, he said, violated his constitutional right to confront witnesses. The trial judge disagreed and now, so has the Supreme Court Appellate Division in Manhattan.


    4/24/08 (VA): Experts Unfairly Barred Say Defense In DC Sniper Case. Washington-area sniper John Allen Muhammad was regularly whipped with hose pipes and electrical cords and beaten with hammers and sticks by family members during a brutal childhood, according to lawyers trying to save him from the death penalty.


    4/23/08 (CA): Expert Testifies White Supremacists Inherently Anti-Police There has been expert evidence that cop killer Bendt Volarvich was an avowed white supremacist. Volarvich, watched as one by one his former associates and jail mates were brought to the stand to testify about his alleged white supremacist affiliation.
