  • Rothgery v. Gillespie County U.S.Supreme Court, June 23, 2008 Criminal, Civil Rights, Constitutional. A criminal defendant's initial appearance before a judicial officer, where he learns the charge against him and his liberty is subject to restriction, marks the start of adversary judicial proceedings that trigger attachment of the Sixth Amendment right to counsel. The Court rules that attachment of the right does not also require that a prosecutor (as distinct from a police officer) be aware of such initial proceeding or be involved in its conduct.
  • Boumediene v Bush U.S.Supreme Court, June 12, 2008 Guantanamo. The U.S. Supreme Court ruled in a 5-4 majority decision that detainees being held at Guantanamo Bay can file suit in federal courts to challenge their detentions.
  • Irizarry v United States U.S. Supreme Court, June 12, 2008. Criminal Procedure, Sentencing. Federal Rule of Criminal Procedure 32(h), (which states that notice must be given to the parties before a court departs from the applicable sentencing range) does not apply to a variance from a recommended Guidelines range.

A death row inmate will not be allowed a DNA test to determine whether he left biological evidence at a murder scene because the results would have made no difference to the jury that condemned him, the California Supreme Court ruled 5 to 2 Thursday.
