  • Bingue v Prunchak, (U.S. 9th Cir., Jan. 15, 2008) Negligence. Police officers involved in all high-speed chases are entitled to qualified immunity under 42 U.S.C. section 1983 unless the plaintiff can prove that the officer acted with a deliberate intent to harm.
  • Rasul v Rumsfeld, (U.S Court of Appeals, D.C, Jan. 11, 2008) Guantanamo. This is the case brought by Guantanamo Bay detainees seeking damages for their alleged illegal detention and torture. Dismissal of claims under the Constitution, the Alien Tort Statute, and the Geneva Conventions was affirmed. However, the claim made under the Religious Freedom Restoration Act ("RFRA") was also denied, having previously been allowed. Click to find out why.
  • Wright v Patten, (U.S Supreme Court, Jan. 7, 2008) Criminal law. Supreme court overturns a decision of 7th Court of Appeals and grants habeas relief from a conviction and sentence for first-degree reckless homicide where no clearly established law contrary to the state court's conclusion justified collateral relief with regard to a claim that petitioner received ineffective assistance of counsel due to his participation in a plea hearing by speaker phone.
  • California v EPA, (U.S. 9th Cir., Jan. 2, 2008) Environmental law. California has sued the U.S. Environmental Protection Agency, charging that the agency wrongfully and illegally blocked the State's tailpipe greenhouse gas emissions standards.
