  • Matthew Dubay v. Lauren Wells, U.S. 6th Circuit [11/06/07] Family, Child Maintenance Interesting arguments advanced in a case where the Plaintiff had never wanted children, and the Defendant had stated that she was infertile. In fact, she became pregnant, and, following a breakdown of the relationship, was the Plaintiff-Appellant then liable for child maintenance?
  • John Allen Muhammad v State of Maryland, Court of Special Appeals, Maryland, [11/05/07] Criminal Appeals. This is the "Beltway Sniper" case. Muhammad was asking the court for a retrial but received little sympathy in a strongly worded, almost scathing judgement.
  • Allen v. Siebert, Supreme Court [11/05/07] Criminal Law / Procedure. The Court affirmed that when a post-conviction petition is untimely under state law, that is the end of the matter for purposes of tolling the AEDPA's 1-year statute of limitations for filing a federal habeas petition.

At the continuing Larissa Schuster trial, prosecutors have called a computer expert who has given potentially damning evidence that the accused had previously 'Googled' various phrases that would help her murder her husband and dispose of the body.


    11/03/07 (IL): Judge Says No To Proposed Expert Testimony In Kelly Case As a follow up to the R.Kelly story (X-Pro News, October, 2007), prosecutors have now failed in their bid to call a potentially crucial expert witness.


    10/30/07 (TX): Texas Computer Experts Must Be Licensed The Private Security Board of The Texas Department of Public Safety issues licenses to experts practicing in computer investigations, and up until now, an expert's validation by the Board was not a pre-requisite to carrying out this line of work.
